Submissions Agreement
By submitting your work for publication to Burningword Literary Journal by Burrdowning Media LLC and its editors (“Publisher”), you (“Author”) agree to the following terms of use:
1. Author grants to Publisher the NON-EXCLUSIVE rights to print, publish, and distribute any and all editions and/or formats of the Work, in whole or in part, in the English language throughout the world.
2a. Author grants to Publisher the NON-EXCLUSIVE right to Electronic versions of the Work. (Electronic versions shall be defined as online and digital reproductions and displays of the verbatim text and illustrations of the Work, or excerpts, for promotional purposes only. This grant of rights shall in no event be deemed to be a grant of electronic-book or audio-recording rights, which are reserved by the Author.)
2b. These non-exclusive rights shall be granted to the Publisher for a period of two (2) years from the date of this agreement, after which time the agreement will automatically renew on an annual basis until such time Author or Publisher chooses to terminate the agreement.
3. The Author vows that the Work is his; that the Work will not infringe upon the personal rights of or give rise to any claim by any third party, including, without limitation, claims in defamation, privacy, copyright, or trademark; and that the Author has the authority to grant us the rights granted in this agreement. The Publisher will have no obligation to publish any part of the Work, which in its opinion would infringe upon such rights of any third party.
4. The Publisher will make no changes or alterations to the textual content of the Work without the Author’s permission and will maintain a byline crediting Author with the Work.
5. Publisher will display the email contact information shared with Publisher by Author on all versions of the publication, including print, eBook, and web, eBook.
6. Publisher will display the third-person biography of the Author if Author submitted one. The Publisher may alter this bio for fit. The Publisher may choose to either omit and rewrite a biography if not submitted in third-person.
7. Modifications to the work by Author, including to biography, byline, contact email, etc., must be done PRIOR to submission. If any error is found or change is needed, the Author agrees to withdraw the original work and resubmit a new version.
8. Publisher agrees to correct any mistakes made by Publisher in a timely manner, including the correction of the print issue.
9. All rights to the Work not expressly granted to Publisher will remain, always, with the Author. The publisher has only the rights described in Paragraphs 1, 2a, and 2b of this Agreement.
